MICHAEL LYNCH FAMILY LAWYERS - A BRISBANE FAMILY LAW PRACTICE
Wills
If you don't have a Will, you need to urgently get one.
If you have a Will, we suggest that after separation you review it carefully to ensure that it accurately reflects what you want to happen to your estate in the event of your death.
Marriage revokes an existing Will unless the Will has expressly been made in contemplation of the new marriage.
A Divorce has the effect of cancelling any gift in the Will in favour of your former spouse but otherwise the Will remains valid. As this may cause confusion, especially if your spouse is appointed your Executor, we suggest that a new Will be prepared.
Powers of Attorney
If you have separated it is important that you revoke any Power of Attorney you have granted in favour of your spouse.
