Christmas Parenting Arrangements: Why now is the time to get organised
Christmas might still feel a little way off, but for separated families who haven’t yet agreed on parenting arrangements over the festive season, time is running out.
Friday, 13 November 2026 is the Federal Circuit and Family Court of Australia’s filing deadline for applications seeking parenting orders for the Christmas and summer holiday period to be considered before Christmas.
With only a few weeks remaining, now is the time to address any uncertainty about where children will spend Christmas Day and how time will be shared over the school holidays.
What if Christmas arrangements are still up in the air?
For many separated families, Christmas arrangements are worked out cooperatively, with parents finding a solution that works for everyone, particularly the children.
But what happens when parents simply can’t agree? Disagreements about Christmas Day, travel, changeover arrangements or how the school holidays will be divided can quickly become stressful, particularly as the holidays draw closer.
If discussions have reached a standstill, there are options available. Negotiation or family dispute resolution may help parents find common ground. Where an agreement cannot be reached, an application to the Court may be necessary.
Why acting early makes a difference
The 13 November deadline is not a date to start thinking about your arrangements. It is the date by which you need to file an application in the court, if they are to be considered for a hearing before Christmas.
Even where an application is filed on time, there is no guarantee the Court will be able to make orders before the holidays, however you have the best chance of being heard before the holidays if you get in before the cutoff.
Leaving things until the last minute can limit your options and create unnecessary pressure at what is already a busy time of year.
A little planning now can make Christmas easier for everyone
Children deserve to enjoy Christmas without being caught in the middle of disagreements between their parents. Having clear arrangements in place early can help everyone make plans, manage expectations and focus on enjoying the festive season.
At Michael Lynch Family Lawyers, we regularly assist separated parents to navigate difficult parenting arrangements, including Christmas and school holiday disputes.
If you haven’t reached an agreement about Christmas, don’t wait until November 13.
