A. No, in fact seeing a solicitor for family law advice at the earliest opportunity may avoid (or bring an end to) contested court proceedings. Seeking the advice of a family lawyer is the best way to arm yourself with information and knowledge regarding the law, the system, your entitlements and your options to resolve the matter.
By seeing a solicitor you are not ‘handing over the steering wheel’ of your life to someone else to make decisions about the direction and outcome of your matter. You are making a very practical decision to inform yourself about the family law system, and then (should you choose to) to work co-operatively to a resolution.
Bear in mind that beyond the misinformed folklore about the court system, court statistics reveal that of the parties who make a court application (which is a very small component of those couples who separate) less than 5% of those applicants end up at a final hearing before a Judge. The fact is that the vast majority of Family Law matters are resolved by agreement.
